Where are proceedings under the StaRUG notified?

Proceedings under the StaRUG (the German Act on the Stabilisation and Restructuring Framework for Businesses) must be notified to the competent restructuring court. The competent restructuring court is the local court (Amtsgericht) in whose district the competent higher regional court (Oberlandesgericht) has its seat (Section 34 (1) StaRUG). A different jurisdiction applies if this local court is not responsible for conducting corporate insolvencies. In this case, the local court responsible for corporate insolvencies at the seat of the higher regional court has jurisdiction. In addition, the federal states may assign jurisdiction by statutory order to another local court in the district of the higher regional court (Sec. 34 (2) StaRUG).
