Are StaRUG proceedings publicly announced?
In restructuring matters under the StaRUG (the German Act on the Stabilisation and Restructuring Framework for Businesses), public announcements are only made if the debtor applies for them. The application must be made before the first decision in the restructuring matter and can only be withdrawn until the first decision (Section 84 (1) sentence 1 StaRUG). Under Sec. 84 (2) no. 2 StaRUG, the information listed in Article 24 (2) of Regulation (EU) 2015/848 must be announced, that is mainly general information on the proceedings and on running deadlines, as well as all court decisions. The public announcement is made by central, cross-state publication on the internet (Sec. 86 (1) StaRUG). IMPORTANT: the public announcement is sufficient proof of service on all parties involved, even if the law also prescribes separate service (Sec. 86 (3) StaRUG).
