What liability risks exist for those involved?
Those involved, in particular managing directors, bear liability risks that are determined by the interests of the creditors. The StaRUG (the German Act on the Stabilisation and Restructuring Framework for Businesses) provides for liability of corporate officers and sets out liability rules in Sections 43 and 57 StaRUG. It is important to identify and minimise liability risks.
